The Texas Supreme court issued an opinion last Friday rejecting a jury award of $9,600,000 against Diamond Offshore Services Ltd.  The court cited the improper exclusion of video evidence that shows an injured oil rig worker performing manual labor. The Texas Supreme Court wrote in its opinion that it was an abuse of the trial court’s discretion to exclude the video — which shows the plaintiff working on a vehicle, operating a mini excavator and doing other activities.
